Penelitian ini menelisik tentang Efektivitas Pengembalian Berkas Perkara dalam prapenuntutan terkhusus terhadap tindak pidana pencabulan anak. Penelitian bertujuan untuk mengetahui lebih lanjut terkait efektiv tidaknya pengembalian berkas perkara dalam pelaksanaan prapenuntutan tindak pidana pencabulan anak serta faktor penghambat apa sehingga berkas perkara tidak dapat dilimpahkan ke tahap penuntutan oleh jaksa di Kejaksaan Negeri Gorontalo.
Penelitian ini dikategorikan pada penelitian yang berjenis empiris, dimana sumber data yang di gunakan adalah sumber data primer yang diperoleh langsung dari lokasi penelitian (field research) di Kejaksaan Negeri Gorontalo, serta sumber data sekunder dengan data yang didapat melalui studi kepustakaan (library research) dengan pengolahan data analisis kualitatif.Berdasarkan hasil penelitian dipahami bahwa 1) Efektivitas Pengembalian Berkas Perkara dalam pelaksanaan Prapenuntutan terhadap tindak pidana pencabulan anak belum mencapai keberhasilan, berangkat dari hasil data pencabulan anak yang masuk ke Pihak kejaksaan serta data berkas perkara yang dapat dilimpahkan ke tahap penuntut oleh pihak kejaksaan, hal tersebut di karenakan disaat pengembalian berkas perkara dalam pemenuhan kelengkapan berkas perkara tidak terpenuhi dalam tenggang waktu yang ditentukan.2) Faktor penghambat berkas perkara tidak dapat dilimpahkan ke tahap penuntutan oleh Jaksa di Kejaksaan Negeri Gorontalo yaitu ketidakmampuan penyidik dalam memenuhi petunjuk yang diberikan oleh Jaksa Penuntut Umum baik itu petunjuk yang berkaitan dengan pemenuhan syarat formil maupun materil.

This research examined the Effectiveness of Returning Case Dossiers in pre-prosecution, especially for the crime of child molestation. Ille research aimed to find out more regarding the effectiveness or returning case dossiers in the preprosecution of child molestation crimes and the inhibiting factors so that case dossiers cannot be submitted to the prosecution phase by prosecutors at the Gorontalo District Attorney's Office.
This research is categorized as an empirical type of research, 'Ahere the data sources used were primary data sources obtained directly from the research location (field research) at the Gorontalo District Attorney's Office, as well as secondary data sources with data obtained through the library research with qualitative analysis data processing. Based on the research results, it was shown that, 1) the effectiveness of returning case dossiers in the implementation of preprosecution of child molestation crimes has not been successful, including the results of child molestation data that enters the Attorney's Office and case dossiers data that can be submitted to the prosecution phase by the Attomey's Office. Such this condition occurs due to during the process of returning the case dossiers, while fulfilling the completeness of the case dossiers, the process is not fulfilled within the specified time limit. 2) Flhe inhibiting factor for the case dossiers to be submitted to the prosecution phase by the Prosecutor at the Gorontalo District Attorney's Office is the inability of the investigator to fulfill the instructions given by the Public Prosecutor, both instructions related to fulfilling formal and material requirements.
